Booking conditions
- These booking conditions concern bookings made by tenants of a villa on Vallée Sainte Baume (hereinafter referred to as: VSB) for recreational use, which by its nature is short in duration.
- A lessee must be 18 years of age or older.
- A booking is deemed to have been made upon receipt by the lessee of the confirmation with the booking amount to be paid. Immediately upon receipt of the confirmation, the lessee must check it for correctness. The lessee shall immediately report any inaccuracies to VSB.
- If the lessee, after making the booking, wishes to make changes of any kind to the booking, VSB shall be entirely free to determine to what extent it will accept the change. Insofar as VSB accepts a change, VSB may charge a change fee.
- Payment of the booking costs must be paid by the lessee in accordance with the payment terms specified with the booking.
- The rented accommodation can be occupied on the agreed day of arrival, as stated on the booking confirmation, from 4:00 PM. On the agreed day of departure, the lessee must have left the accommodation by 10.00 AM.
- The lessee must deliver their accommodation clean and tidy, i.e. no dirty dishes, bed linen must be removed and folded, refrigerator(s) must be emptied and cleaned and garbage bags must be deposited in the garbage containers outside the VSB. Insofar as the lessee has failed to do so, the costs of putting things in order will be deducted from the deposit.
- All guests must comply with all the provisions in the Park Regulations. These regulations are also available at the reception of VSB. In the event of violation of the Park Regulations and/or failure to follow the instructions of the manager, the manager has the right to immediately remove the lessee and each of his/her guests from the villa park without restitution of the rent or part thereof.
- Each accommodation may only be occupied by the number of persons agreed at the time of booking, i.e. the guests.
- All guests are required to use bed linen (bottom and top sheets and pillowcase). Bed linen packages can be rented at the reception of VSB. It is also mandatory to use the available under-blankets (mattress covers).
- Guests and visitors are not allowed to park a car or trailer in the garages present at the villas.
- Guests and visitors are not allowed to smoke in any room in a villa.
- A pet will only be admitted to VSB if the wish to bring this pet is clearly stated at the time of booking and this is also mentioned as such in the confirmation. Other pets are not allowed.
- Visitors' pets are not allowed.
- Visitors may only use VSB's general facilities in the presence of the lessee who has invited them. The lessee must notify the manager of the use in advance.
- The number of visitors per lessee may not exceed the number of guests of the rented accommodation in question.
- The lessee is responsible and jointly and severally liable for an orderly course of affairs within and around the rented accommodation or elsewhere within and around VSB insofar as it concerns his/her guests and/or visitors.
- Lessee is always liable during the entire rental period, which does not affect the liability of other users for damage due to breakage and/or loss and/or damage to the accommodation and its inventory, garden, terraces and private swimming pool where applicable. Any damage shall be immediately reported by the lessee to the manager of VSB and shall be compensated or settled on the spot and, if necessary, deducted from the deposit paid.
- Lessee must check within 48 hours after arrival whether the inventory list is correct in each house. Missing items and/or damage to the items on this list must be reported immediately to the manager of VSB. The already departed lessee is still liable for missing items and/or damage to items that is detected within 48 hours after departure of a lessee. If the new lessee does not report the loss and/or damage within this period, then this lessee is deemed to have caused this loss/damage or is liable for it.
- VSB requires a deposit from the lessee at the beginning of the stay as indicated at the time of booking. If the deposit is not paid at the beginning of the stay, the manager of VSB shall be entitled to deny the lessee access to and use of the rented accommodation.
- The deposit will be refunded within 14 days of the lessee's departure after deduction of any damage and/or costs due to loss or failure to deliver the accommodation properly. If desired, the lessee can request a specification of this settlement from the manager.
- If a reservation is cancelled, a cancellation fee is due, namely:
- in case of cancellation up to the 42nd day (not included) before the day of arrival: the deposit; in case of cancellation from the 42nd day (included) until the 28th day (not included) before the day of arrival: 35% of the travel sum;
- in case of cancellation from the 28th day (included) until the 21st day (not included) before the day of arrival: 40% of the travel sum;
- in case of cancellation from the 21st day (included) until the 14th day (not included) before the day of arrival: 50% of the travel sum;
- in case of cancellation from the 14th day (included) until the 5th day (not included) before the day of arrival: 75% of the travel sum;
- in case of cancellation from the 5th day (included) until the day of arrival: 90% of the travel sum;
- in case of cancellation on the day of arrival: the full travel sum.
- If the lessee has not arrived within 24 hours after the agreed date of arrival without giving reasonably acceptable reasons, this will be considered as a cancellation.
- If VSB is unable to fulfil its obligation to make the rented accommodation available to the lessee due to force majeure, such as fire, strikes, blockades, war and the like, the lessee shall be entitled to a refund of the part of the rent already paid without VSB being obliged to compensate any damage in that case. VSB shall endeavour to inform the lessee of such a situation as soon as possible.
- VSB has the right to terminate the rent with immediate effect at any time if it appears that the personal details provided at the time of booking are incorrect. In such a case there will be no refund of the rent or any part thereof.
- Neither VSB nor the individual owners shall be liable for loss, theft, injury or damage of any kind caused to guests, unless there is gross negligence on the part of VSB or its employees. Liability based on gross negligence or a wrongful act is in any case limited to 75,000 euros for personal accidents per guest per stay and liability for material damage is in any case limited to a maximum of 1,500 euros per lessee per stay.
- In the event that the rented accommodation has a private swimming pool, the lessee is personally responsible and liable for the safety in and around that pool.
- Lessees and/or guests shall indemnify VSB against all claims relating to damage to their property by third parties resulting from any acts or omissions of VSB, its employees, owners of VSB accommodations or third parties located within VSB.
- In the unlikely event that the lessee has a complaint concerning VSB or the rented accommodation, the lessee shall in the first instance and immediately report this complaint to the manager of VSB. If the complaint is not dealt with to the satisfaction of the lessee, the lessee must notify the manager in writing before departure. In that case, the management of VSB shall endeavour to settle the complaint within 1 month after departure in a manner satisfactory to the lessee. If this does not lead to a satisfactory solution, the lessee may submit the complaint to the legally competent court. The costs incurred by the tenant for the purpose of such legal proceedings shall not be reimbursed by VSB. VSB, on the other hand, is entitled to reimbursement of its extrajudicial and judicial costs in situations that occur.
- With these booking conditions, all previous publications in this respect will lapse.
- These booking conditions are subject to French law.
